INFORMAZIONI RESE AI CLIENTI SUL TRATTAMENTO DEI DATI PERSONALI
ex Art.13 del Regolamento (UE) 2016/679 – GDPR
La presente informativa viene resa ai clienti persone fisiche e alle persone fisiche che operano in nome e per conto dei clienti persone giuridiche, della società GVJ di Longo Andrea & C. snc ai sensi dell'art.13 GDPR 679/2016 - "Regolamento europeo generale sulla protezione dei dati personali" (di seguito anche "GDPR").
1. Identità del Titolare e contatti
Il Titolare del trattamento dei dati dei clienti persone fisiche, o delle persone fisiche che operano in nome e per conto dei clienti persone giuridiche (di seguito anche "Interessato"), è la società:

2. Oggetto del trattamento
I dati personali trattati sono quelli forniti dall'Interessato in occasione di:
• visite o telefonate presso la nostra sede legale;
• richieste di informazioni, anche via mail;
• conclusione ed esecuzione di contratti;
• informazioni su transazioni /fatturazioni.
3. Finalità del trattamento
I dati personali dei clienti persone fisiche, se forniti, sono trattati dal Titolare del trattamento per:
• acquisire dati e informazioni precontrattuali;
• gestire e controllare i rischi, prevenire possibili frodi, insolvenze o inadempienze;
• effettuare le operazioni necessarie per l'evasione degli ordini e delle altre richieste;
• prevenire e gestire possibili contenziosi, adire le vie legali in caso di necessità;
• gestire la contabilità e gli adempimenti fiscali;
Inoltre, sono trattati dal Titolare del trattamento e dal Consulente fiscale per:
• gestire gli adempimenti di natura amministrativa, contabile, civilistica, fiscale;
• predisporre e presentare dichiarazioni e documenti di natura civilistica, fiscale, previsti da leggi, regolamenti, norme e direttive comunitarie ed extra comunitarie.
I dati personali delle persone fisiche che operano in nome e per conto dei clienti persone giuridiche, se forniti, sono trattati dal Titolare del trattamento per:
• inoltrare comunicazioni di servizio e con diversi mezzi di comunicazione (telefono, cellulare, sms, e-mail, fax, posta cartacea);
• formulare richieste o evadere richieste pervenute;
• scambiare informazioni finalizzate all'esecuzione del rapporto contrattuale, ivi comprese le attività pre e post contrattuali;
• effettuare le operazioni necessarie per l'evasione degli ordini e delle altre richieste.
4. Modalità di trattamento
Tutti i trattamenti, sia automatici che manuali, effettuati dal Titolare sono conformi alla normativa contenuta nel GDPR e ai principi in esso enucleati e qui di seguito indicati:
• Liceità: GVJ DI LONGO ANDREA & C. SNC tratterà i dati personali di cui è Titolare nel rispetto dei diritti di ogni interessato e nei limiti del suo consenso, nonché di quanto previsto nella presente informativa e nei contratti eventualmente stipulati;
• Minimizzazione: il Titolare utilizzerà il minor numero possibile di dati personali, ossia solamente quelli che risulteranno necessari per i trattamenti e le finalità descritte.
• Sicurezza: Il Titolare garantisce l'applicazione di misure di sicurezza idonee alla tutela dei dati raccolti e trattati e a quella delle libertà fondamentali degli Interessati.
• Correttezza: Il Titolare predispone per gli Interessati gli strumenti adeguati alla verifica della veridicità ed aggiornamento dei propri dati personali ed eventuale modifica degli stessi.
• Trasparenza: il Titolare adotta misure appropriate per fornire all'Interessato tutte le informazioni relative al trattamento e agevola l'esercizio dei suoi diritti.
• Limitazione: il Titolare raccoglie i dati per finalità determinate, esplicite e legittime, come sopra esposto, e successivamente li conserva per un arco di tempo non superiore al conseguimento delle suddette finalità.
• Esattezza: il Titolare adotta tutte le misure ragionevoli per aggiornare, cancellare o rettificare tempestivamente i dati inesatti rispetto alle finalità per le quali sono trattati.
• Integrità e riservatezza: il Titolare adotta le migliori tecniche di gestione dei Dati funzionali alla migliore fruibilità dei medesimi attraverso il Sito, compresa la protezione da trattamenti non autorizzati o illeciti e dalla perdita, distruzione o danno accidentali.
5. Destinatari dei dati
I dati personali trattati dal Titolare non saranno diffusi, ma potranno essere comunicati ai lavoratori che operano alle dipendenze del Titolare e ad alcuni soggetti esterni che con essi collaborano. Potranno inoltre essere comunicati, nei limiti strettamente necessari, ai soggetti che per finalità di evasione degli ordini o di altre richieste o di prestazioni di servizio relativi alla transazione o al rapporto contrattuale con il Titolare, debbano fornire beni e/o eseguire su incarico del
Titolare prestazioni o servizi. Infine, potranno essere comunicati ai soggetti legittimati ad accedervi in forza di disposizioni di legge, regolamenti, normative comunitarie.
In particolare, sulla base dei ruoli e delle mansioni lavorative espletate, alcuni lavoratori sono stati legittimati a trattare i dati personali, nei limiti delle loro competenze ed in conformità alle istruzioni ad essi impartite dal Titolare, nel pieno rispetto del GDPR.
6. Trasferimento dei dati
Il Titolare del trattamento non trasferisce i dati personali in paesi terzi o ad organizzazioni internazionali. Tuttavia, si riserva la possibilità di utilizzare servizi in cloud, nel qual caso i fornitori dei servizi saranno selezionati tra coloro che forniscono garanzie adeguate, così come previsto dall'art. 46 GDPR. 7. Conservazione dei dati
I dati personali degli interessati saranno trattati e conservati dal Titolare per l’intera durata del rapporto contrattuale/commerciale e, al termine dello stesso per qualsivoglia ragione, saranno conservati per il tempo previsto dalla vigente normativa in materia contabile, fiscale, civilistica e processuale.
8. Rifiuto al conferimento dei dati
I clienti persone fisiche non possono rifiutarsi di conferire al Titolare i dati personali necessari per ottemperare le norme di legge che regolamentano le transazioni commerciali e la fiscalità.
Il conferimento di ulteriori dati personali potrebbe essere necessario per migliorare la qualità e l'efficienza della transazione.
Pertanto, il rifiuto al conferimento dei dati necessari per legge impedirà l'evasione degli ordini; mentre il conferimento dei dati ulteriori potrebbe compromettere in tutto o in parte l'evasione di altre richieste e la qualità e l'efficienza della transazione stessa.
Le persone che operano in nome e per conto dei clienti persone giuridiche possono rifiutarsi di conferire al Titolare i loro dati personali.
Il conferimento dei dati personali è però necessario per una corretta ed efficiente gestione del rapporto contrattuale. Pertanto, un eventuale rifiuto al conferimento potrebbe compromettere in tutto o in parte il rapporto contrattuale stesso. Il conferimento dei dati personali per attività di marketing è invece facoltativo e, pertanto, l'Interessato è libero di fornire o meno il suo esplicito e separato consenso. Qualora l'Interessato non accetti il trattamento per finalità di marketing, GVJ DI
LONGO ANDREA & C. SNC non potrà inviare materiale pubblicitario o semplici comunicazioni relative ai servizi dalla medesima offerti.
9. Processi decisionali automatizzati
Il Titolare effettua trattamenti che consistano in processi decisionali automatizzati sui dati degli interessati, basati prevalentemente sull’utilizzo di un software gestionale CRM, mediante il quale non si hanno impatti significativi sui diritti degli interessati medesimi. Tuttavia, l’interessato può richiedere l’intervento umano anche nello svolgimento dei processi decisionali automatizzati. Va precisato che tali tipologie di trattamenti sono attuate unicamente in quanto necessarie e/o funzionali per la conclusione e l’esecuzione di un contratto di tra l’interessato e il Titolare del trattamento.
10. Diritti dell'Interessato
L'interessato ha diritto ad esercitare tutti i diritti previsti dal GDPR, in particolare agli artt. 9: diritto di reclamo, 15: diritto di accesso, 16: diritto di rettifica, 17: diritto alla cancellazione/oblio, 18: diritto alla limitazione del trattamento, 20: diritto alla portabilità dei dati, 21: diritto di opposizione al trattamento. L'Interessato potrà esercitare tali diritti scrivendo al Titolare del trattamento all'indirizzo della sede legale, oppure a mezzo e-mail, specificando l'oggetto della sua richiesta, il diritto che intende esercitare e allegando fotocopia di un documento di identità che attesti la legittimità della richiesta.
11. Revoca del consenso
Con riferimento all'art. 6 del GDPR, l'Interessato può revocare m qualsiasi momento il consenso eventualmente prestato. Tuttavia, il trattamento oggetto della presente informativa è lecito e consentito, anche in assenza di consenso, in quanto necessario all'esecuzione di un contratto di cui è parte l'interessato (il rapporto di fornitura di prodotti o servizi) o all'evasione di sue richieste.
12. Proposizione di reclamo
L'Interessato ha il diritto di proporre reclamo all'autorità di controllo dello stato di residenza.

We collect general information. This includes: name; contact information including email address; demographic information; other information.
Definition of personal data
In the EU General Data Protection Regulation (GDPR), personal data is defined as follows:
Any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Legal basis for the collection of personal data
Insofar as we obtain your consent for the processing of personal data, Art. 6 para. 1 lit. a GDPR serves as the legal basis for the processing of your personal data.
When processing your personal data to fulfil a contract between you and GVJ S.N.C. DI LONGO ANDREA & C., Art. 6 para. 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.
Insofar as the processing of personal data is required to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis.
If processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for the processing.
Data erasure and storage period
The personal data of the data subject will be erased or the processing restricted blocked as soon as the purpose of storage cases to apply. Furthermore, data may be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. The data will also be restricted or deleted if a storage period prescribed by the aforementioned legal provisions expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.
Collection and processing of personal data
Personal data is only collected if you provide it voluntarily, for example to carry out an order, a survey, a contest or a registration for personalised services. There you will be informed about the intended purpose of processing and, if necessary, asked for your consent to storage.
The personal data collected within the framework of our websites will only be used without your consent for order processing or processing your enquiries. Data transmission to other Group companies
A transfer of your data to third parties outside t GVJ S.N.C. DI LONGO ANDREA & C. does not take place, unless we are legally obliged to do so, or the transfer of data is necessary for the execution of the contractual relationship. External service providers and partner companies only receive your data if this is necessary to process your request. In these cases, however, the scope of the transmitted data is limited to the required minimum. As far as our service providers come into contact with your personal data, we ensure that they comply with the regulations of the data protection laws in the same way. The respective service provider is responsible for the contents of external services, whereby we check the services within the scope of reasonability for compliance with legal requirements.

- Right of Access, Art. 15 GDPR
You can ask us to confirm whether or not we process your personal data. If we have processed your data, you have further rights to information as set out in Article 15 of the GDPR.
- Right to Rectification
If the information we have collected from you is incorrect or incomplete, you may immediately request us to correct it in accordance with Article 16 of the GDPR.
- Right to restriction of processing
Under the requirements of Art. 18 GDPR, you may also request that the processing of personal data concerning you be restricted.
After the restriction, your data may only be processed with your consent or for the purpose of asserting, exercising or defending legal claims, or for the protection of the rights of another natural or legal person, or on grounds of an important public interest of the Union or a Member State. We will inform you before the restriction is removed.
- Right to Erasure
If one of the reasons in Art. 17 para. 1 GDPR applies, you can request us to delete your personal data immediately, unless there is an exception to the deletion obligation in accordance with Art. 17 para. 3 GDPR.
- Right to Notification
If you have exercised your right to rectification, erasure or restriction of processing, we are obliged under Article 19 GDPR to inform all recipients of your personal data of this, unless the notification is impossible or involves disproportionate effort. You also have the right to be informed of the recipients. The person responsible shall have the right to be informed of such recipients.
- Right to Data Portability In addition, according to Article 20 GDPR, you have the right to receive personal data concerning you from us in a machine-readable format and to transmit the data to another controller without hindrance, provided that the requirements of Article 20 para. 1 lit. a GDPR are met, or to obtain that your personal data are transmitted directly by us to another controller, provided that this is technically feasible and no freedoms and rights of other persons are impaired thereby. This right shall not apply to the processing of personal data necessary for the performance of a task in the public interest or for the exercise of official authority.
- Right to object
You have the right to object to the processing of personal data by GVJ S.N.C. DI LONGO ANDREA & C. concerning you pursuant to Art. 6 para. 1 lit. f GDPR at any time.
We will no longer process your personal data, unless there are grounds for processing worthy of protection overriding your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
- Right to revoke the data protection declaration of consent
You have the right to revoke your data protection declaration of consent with a statement to GVJ S.N.C. DI LONGO ANDREA & C. at any time. The revocation of consent shall not affect the legality of the processing carried out on the basis of the consent until revocation.
- Right to lodge a complaint with a supervisory authority
You have the right, at all times, without prejudice to any other administrative or judicial remedy, to lodge a complaint with a supervisory authority, in particular in the Member State of your place of residence, of work or of the place of suspected infringement, if you consider that the processing of personal data concerning them is contrary to this Regulation.
